By visiting the Site, or by purchasing or using the Service, you accept the privacy practices described in this Policy.

KPEYE is a collaborative community. This means that many portions of our Service, including information you voluntarily provide, will be public-facing for the sharing of innovative ideas and information. Data privacy is of high importance for KPEYE and we want to be open and transparent with our processing of your personal data. We strive to respect the privacy of individual community members and will minimize the information we collect and share. If you do not want to share your information, including personally identifiable information, with other community members and the public, please be thoughtful as to how you interact with our Service and what information you provide through the Service (for example, through creating a public profile, news feed contributions, comments, and posts).

DEFINITIONS

“Client” means a company, virtual company or community of KPEYE.

“Client Data” means personal data, reports, addresses, and other files, folders or documents in electronic form that a User of the Service stores within the Service.

“Personal Data” means any information relating to an identified or identifiable natural person.

“Public Area” means the area of the Site that can be accessed both by Users and Visitors, without needing to log in.

“User” means a manager, sales (person), staff, community admins or other representatives of a Client, who primarily uses the restricted areas of the Site for the purpose of accessing the Service in such capacity.

WHERE DO WE STORE YOUR DATA?

The data that we collect from you is stored within the European Economic Area (“EEA”) but may also be transferred to and processed in a country outside of the EEA. Any such transfer of your personal data will be carried out in compliance with applicable laws. For transfers outside the EEA, KPEYE will use Standard Contractual Clauses and Shields as safeguards for countries without adequacy decisions from the European Commission.

WHAT INFORMATION DO WE COLLECT?

We collect different types of information from or through the Service. The legal bases for KPEYE’s processing of personal data are primarily that the processing is necessary for providing the Service.

User-provided Information

When you use the Service, as a User or as a Visitor, you may provide, and we may collect Personal Data. Examples of Personal Data include name, email address, mailing address, mobile phone number, and credit card or other billing information. Personal Data also includes other information, such as geographic area or preferences, when any such information is linked to information that identifies a specific individual. Information Collected by Clients

A Client or User may store or upload into the Service Client Data. KPEYE has no direct relationship with the individuals whose Personal Data it hosts as part of Client Data. Each Client is responsible for providing notice to its customers and third persons concerning the purpose for which Client collects their Personal Data and how this Personal Data is processed in or through the Service as part of Client Data.

“Automatically Collected" Information

When a User or Visitor uses the Service, we may automatically record certain information from the User’s or Visitor’s device by using various types of technology, including cookies, “clear gifs" or “web beacons.” This “automatically collected" information may include IP address or other device address or ID, web browser and/or device type, the web pages or sites visited just before or just after using the Service, the pages or other content the User or Visitor views or interacts with on the Service, and the dates and times of the visit, access, or use of the Service. DOES KPEYE USE COOKIES?

Yes. As described in Section “Automatically Collected" Information of our Privacy Policy, we use cookies and other technologies to ensure everyone who uses KPEYE has the best possible experience. Cookies also help us keep our Clients’ account safe. By continuing to visit or use our Service, you are agreeing to the use of cookies and similar technologies for the purposes we describe in this policy.

Please note that certain features of the Service will not be available once cookies are disabled. WHO CAN ACCESS YOUR DATA?

Your data may be shared within the KPEYE Service. We never pass on, sell or swap your data for marketing purposes to third parties outside the KPEYE Service.

Data that is forwarded to third parties, is only used to provide you with our services. You will find categories of third parties under every specific process below.

WHAT IS THE LEGAL GROUND FOR PROCESSING?

For every specific process of personal data, we collect from you, we will inform you whether the provision of personal data is statutory or required to enter a contract and whether it is an obligation to provide the personal data and possible consequences if you choose not to.

Right to access:

You have the right to request information about the personal data we hold on you at any time. You can contact KPEYE and we will provide you with your personal data via e-mail.

Right to portability:

Whenever KPEYE processes your personal data, by automated means based on your consent or based on an agreement, you have the right to get a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.

Right to rectification:

You have the right to request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data completed.

If you have an KPEYE account, you can edit your personal data under your account pages.

Right to erasure:

You have the right to erase any personal data processed by KPEYE at any time.

Your right to object to processing based on legitimate interest:

You have the right to object to processing of your personal data that is based on KPEYE’s legitimate interest. KPEYE will not continue to process the personal data unless we can demonstrate legitimate grounds for the process which overrides your interest and rights or due to legal claims.

Your right to object to direct marketing:

You have the right to object to direct marketing, including profiling analysis made for direct marketing purposes.

You can opt out from direct marketing by the following means:

  • following the instruction in each marketing emails
  • by editing the settings of your KPEYE account
Right to restriction:

You have the right to request that KPEYE restricts the process of your personal data under the following circumstances:

  • if you object to a processing based KPEYE’s legitimate interest, KPEYE shall restrict all processing of such data pending the verification of the legitimate interest.
  • if you have claim that your personal data is incorrect, KPEYE must restrict all processing of such data pending the verification of the accuracy of the personal data.
  • if the processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead
  • if KPEYE no longer needs the personal data but it is required by you to defend legal claims.

HOW CAN YOU EXERCISE YOUR RIGHTS?

Right to complain with a supervisory authority:

If you consider KPEYE to process your personal data in an incorrect way you can contact us. You also have the right to raise a complaint to a supervisory authority.

Updates to our Privacy Notice:

Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time. If we modify the Policy, we will make it available through the Service, and indicate the date of the latest revision, and will comply with applicable law.
